QoS also applies to static routes?

Hi, I have a static route going to a router
(the gateway is on the router's LAN side, not WAN)
I have Qos setup for my net connection and it's set to the WAN port (256k up 2048 down). Whenever I max my internet connection latencies to the WAN side rise which is normal,and latency within the LAN is fine however latency rises on the static route which shouldn't be happening since it's not on the WAN side. Any idea why this happens?
